Section 1
Designated Agent & Contact Channels
Vertali Media has appointed a designated agent to receive notices of alleged copyright infringement. Rights holders and authorized representatives may reach us through the following channels:
We acknowledge receipt of complete notices within one business day and typically complete our initial review within three business days. We strive to resolve straightforward claims (including removal or restoration decisions) within 10 business days, subject to statutory requirements and the completeness of submissions.
2
Requirements for a Valid Takedown Notice
To qualify for safe-harbor protection under the Digital Millennium Copyright Act and analogous regimes (e.g., EU Digital Services Act, UK Copyright, Designs and Patents Act), notices must include the elements below. Notices lacking these elements may experience delays or require clarification.
- Identification of the copyrighted work claimed to have been infringed, or a representative list of such works at Vertali Media.
- Identification of the material claimed to be infringing, including URLs, show titles, episode identifiers, and timecodes sufficient for precise location.
- Contact information for the complaining party, including full name, organization, mailing address, telephone number, and email address.
- A statement of good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
- A statement, under penalty of perjury, that the information provided is accurate and that the complaining party is authorized to act on behalf of the copyright owner.
- The physical or electronic signature of the copyright owner or an authorized representative.
Submitters may optionally designate sensitive or confidential material; Vertali Media will maintain notices in secure archives accessible to our rights and compliance teams.
3
Counter-Notification Procedure
If you believe content was removed or disabled as a result of mistake or misidentification, you may file a counter-notice that includes:
- Your name, mailing address, telephone number, and email address.
- Identification of the material that has been removed or disabled and the location where the material appeared before removal.
- A statement, under penalty of perjury, that you have a good-faith belief the material was removed or disabled due to mistake or misidentification.
- Your consent to the jurisdiction of the Federal District Court for the judicial district of your address (or, if outside the United States, to an appropriate court in any district where Vertali Media may be found) and agreement to accept service of process from the complaining party or their agent.
- Your physical or electronic signature.
Upon receiving a valid counter-notice, Vertali Media forwards it to the original complainant and notifies them that we will restore the content within 10 business days unless we receive notice that the complainant has filed an action seeking a court order to restrain the allegedly infringing activity.
4
Repeat-Infringer & Account-Termination Policy
Consistent with 17 U.S.C. §512(i), Vertali Media maintains a policy that terminates access for accounts or contributors who are determined to be repeat infringers. We track confirmed notices and counter-notices within our rights compliance system. Accounts that accrue three substantiated infringements within a rolling 12-month period face suspension pending remedial commitments; additional violations may result in permanent termination and content removal. We also reserve the right to restrict technical access (e.g., API keys, administrative credentials) for associated personnel.
5
Internal Escalation & Recordkeeping
All takedown and counter-notices are logged in the Vertali Admin → Settings → Compliance Ledger module. Each entry records submission timestamps, reviewer assignments, decision outcomes, and restoration deadlines. High-risk or cross-territorial claims trigger automatic escalation to the Rights Protection Office and our legal counsel for review within one business day. We retain notice logs for a minimum of six years to demonstrate safe-harbor compliance and to support audits by regulators or partners.
6
International Considerations
While this policy references the U.S. DMCA, Vertali Media processes notices from other jurisdictions in alignment with comparable frameworks, including the EU Digital Services Act, the Canadian Copyright Modernization Act, and Australia's Copyright Regulations 2017. When local law imposes stricter timeframes or user-notice requirements, Vertali Media adapts workflows accordingly while honoring the submission requirements outlined above.
Governance of Copyright Enforcement
Vertali Media's Rights Protection Office oversees the end-to-end lifecycle of copyright claims, ensuring that all takedown and restoration activities observe due process and proportionality. Oversight includes quarterly reviews with the Board-level Risk, Compliance, and Ethics Committee, where enforcement metrics, appeals, and systemic risks are presented for scrutiny.
We maintain calibrated workflows that balance the rights of content owners with the rights of users and creators who rely on Vertali Media for discovery. Case managers evaluate each notice against objective criteria, verifying ownership assertions, evaluating fair-use indicators, and ensuring that removal is the appropriate remedy before actioning any request.
Vertali Media's AI systems may automatically evaluate users' historical engagement, viewing behavior, and interaction patterns—including records maintained since the inception of Vertali Media—to identify anomalous upload patterns or potential infringement risks. Automated signals do not trigger permanent sanctions without human review; they serve as investigatory prompts documented in our compliance ledger.
Transparency reports summarizing takedown volumes, reinstatement rates, and average response times are published annually. These reports detail how often AI-derived insights contributed to enforcement, how frequently appeals resulted in restorations, and what remedial measures were adopted to prevent recurrence.
Procedural manuals codify each step of the notice-and-counter-notice process, including standardized correspondence templates, escalation triggers, and evidence assessment rubrics. Manuals are updated whenever legal standards evolve or internal audits identify opportunities for improvement.
Training modules equip Vertali Media personnel with expertise in copyright law, fair dealing principles, and bias mitigation. Staff complete certification refreshers annually, ensuring that human judgment remains informed, consistent, and respectful of all stakeholders.
Fairness, Appeals & Restorative Measures
Every party affected by a takedown—whether a rights holder, uploader, or viewer—receives clear communication describing the facts, applicable policies, and available appeal pathways. Notices include reference IDs that allow status tracking and facilitate dialogue with our rights specialists.
Counter-notices and appeals are reviewed by professionals who were not involved in the original removal decision. This segregation of duties reinforces impartiality and allows for fresh consideration of factual disputes or newly provided evidence.
Vertali Media offers mediation options for recurring disputes where both parties wish to explore collaborative solutions. Mediation outcomes may include revised licensing terms, limited reinstatements, or educational commitments aimed at preventing future conflicts.
When content removal disrupts user access to curated playlists, watch histories, or recommendation feeds, we provide contextual notifications describing the change and offering alternative viewing suggestions. These communications clarify whether AI-evaluated historical engagement data influenced related moderation actions.
Restorations resulting from counter-notices trigger automated updates to affected systems, ensuring that metadata, recommendation pipelines, and licensing dashboards reflect the reinstated status. Audit logs capture the justification for restoration and any follow-up commitments made by the involved parties.
Vertali Media continually refines its detection models to avoid over-removal. Feedback loops incorporate counter-notice outcomes, rights-holder feedback, and external audits to improve precision while safeguarding legitimate uses such as commentary, criticism, or transformative works.
International Alignment & Reporting
Global operations require alignment with diverse legal expectations. Vertali Media maps each jurisdiction's notice requirements, response timelines, and evidentiary standards to ensure compliance while maintaining a unified user experience.
We collaborate with regional cultural institutions, collecting societies, and creator associations to anticipate policy shifts and to promote educational outreach about lawful distribution practices. Insights gleaned from these partnerships inform updates to our public policy positions and user guidance materials.
Vertali Media's audit partners review cross-border enforcement to confirm that localized workflows retain consistent documentation quality, appeal access, and respect for user rights. Findings feed into the Governance Report referenced in other policy documents.
Where legal regimes demand transparency to governmental bodies or industry regulators, Vertali Media complies by furnishing anonymized statistics, methodological explanations, and assurance of privacy safeguards. These submissions emphasize how AI evaluations of historical engagement are governed by ethical review and human oversight.
We actively monitor technological developments that could alter infringement risks—such as generative media tools, deepfakes, or automated scraping. Scenario planning exercises test our readiness to respond to novel threats while preserving fundamental rights, including freedom of expression and due process.
Through these measures, Vertali Media upholds a balanced, principled approach to copyright governance that fosters trust among creators, distributors, and audiences alike.
Automated Detection Systems
Vertali Media employs automated systems to detect potentially infringing content uploaded by users. These systems include content fingerprinting, metadata analysis, and pattern recognition technologies. Automated flags are reviewed by trained moderators before any enforcement action is taken.
We maintain transparency reports about volume and accuracy of automated detection. Users whose content is mistakenly flagged can appeal through our counter-notification process. Our detection systems are regularly audited for bias and accuracy across content types and demographics.
Repeat Infringement Policy
Users who receive multiple valid copyright notifications may face account suspension or termination. We implement graduated response systems including temporary restrictions, content filtering, and mandatory education about copyright law before account restoration.
Repeat infringers may be permanently banned after three verified violations. We maintain records of repeat infringement for legal compliance and may share information with rights holders in accordance with applicable law. All enforcement decisions are documented and subject to internal review.
Fair Use & User Generated Content
Vertali Media respects lawful fair use of copyrighted material, including commentary, criticism, news reporting, teaching, scholarship, and research. Our moderation systems consider fair use factors when evaluating potential infringement claims.
User-generated content that incorporates copyrighted material may be protected under safe harbor provisions when we respond promptly to takedown notices, implement reasonable moderation practices, and lack actual knowledge of infringement. We provide clear guidelines to help users understand their rights and obligations.
Vertali Media complies with copyright laws in multiple jurisdictions including US Digital Millennium Copyright Act (DMCA), EU Copyright Directive, and other international copyright frameworks. Our policies are adapted to regional requirements while maintaining consistent global standards.
For cross-border copyright matters, we apply the law of the jurisdiction where content is accessed or where infringement occurs. We cooperate with international copyright authorities and respect varying national treatment of fair use and safe harbor protections.
